Bankruptcy and Restructuring

Most of the main bankruptcy proceedings and out of court restructurings have been carried on under the advice and representation of Roitman-Abogados in the city of Córdoba. In the middle of the 1990’s the firm expanded to the city of Buenos Aires.

Right after the reform of the Bankruptcy Code in 1995, which entitled the corporations owned by the state to file for “Concurso Preventivo” (judicial restructuring of debt), the first such case was assigned by the Federal State to the firm. This has been so far the best experience in reorganizing debt, with even better results than those obtained by administrative law.

Recently the firm was retained to be part of a group of firms charged with filing for restructuring of a concessionary of public services.

Banks

From its very beginning, the firm has advised cooperatives of loans for small business, transformed in the 1940s into the first private bank in the city of Córdoba.
Later on other banks from Córdoba and Buenos Aires became major clients.

The firm developed all the instruments for consumer credit, and recently the first credit card combined with a system of an immediate finance.

Arbitration

Horacio Roitman performed as arbitrator and expert witness in Argentine Law in arbitration proceedings filed with the International Chamber of Commerce (Paris).

He is a permanent member of the Arbitration Tribunals of the "Bolsa de Comercio de Córdoba" (Córdoba Stock Exchange) and the Argentine Chamber of Commerce.

Apart from the experience of Mr. Roitman, all members of the firm have experience in disputes filed with the Arbitration Tribunal of the Bolsa de Comercio de Buenos Aires and in private conflicts in various jurisdictions of the country.

Litigation

The firm represented before the courts of Córdoba, Santa Fé, Tucumán, Mendoza and Buenos Aires in all kinds of corporate conflicts, and has wide recognition in Court and the business community.

It has represented small groups of shareholders as well as many corporations.

Mergers and acquisitions, selling of enterprises and takeovers have been part of our ongoing activities.

The firm has been contracted for litigation before the Superior Court of Justice of the Province and the Federal Supreme Court.

Insurance

The firm has developed important counseling on liability insurance, and aggravation of risk that later result in national and foreign publications, as well as labor insurance and labor personal injury.

As a consequence of this specialty Dr. Horacio Roitman was appointed director of the first career of Specialist in Insurance Law at the National University of Córdoba.

Under the patronage of the European Economic Community, he participated as a member of the Alfa Plan between four European universities and three Latin American universities (Lovaina, Paris I, Pontificia de Salamanca, San Pablo, Javeriana de Bogotá, Austral, UNC) which organized a program of studies on insurance for students of both continents.
